On March 31, 2020, the Department of Agriculture Animal and Plant Health Inspection Service (APHIS) announced Phase Six of the Lacey Act enforcement schedule would begin on October 1, 2020. This date was later changed to July 1, 2021, after public comment. On July 2, 2021, APHIS published additional information in the Federal Register, including a further postponement of the mandatory data reporting requirement date to October 1, 2021.
With this requirement, the declaration must contain, among other things, the scientific name of the plant, the value of importation, the quantity of the plant, and the name of the country from which the plant was taken. In addition, APHIS noted the final list of products subject to the new reporting requirements.

It is noted that goods classified under heading 4415, such as wooden pallets, boxes, etc., are only affected by the new requirements if the articles imported are new and are not being used in the transportation of goods. Only new pallets and other wooden shipping containers being shipped to the U.S. without being loaded with cargo are subject to the reporting requirements. Used containers and new containers being used in the transportation of cargo are exempt from the reporting requirements.
